These general conditions of contract govern the storage of the car at the facilities of the company Bombaci Servizi of G. Bombaci & C. – Via Volturno 8 – 91100 Trapani.
P. IVA 02527360818, owner of the “Airone Parking” car park located in Contrada Pozzillo – 90045 Cinisi, for the agreed period, in addition to the free transport of people and luggage.
The parking and storage of vehicles at the car park will automatically entail the acceptance of articles 1341-1342 of the Civil Code and of the underlying conditions that the user expressly declares to have viewed and examined at the premises of the company Bombaci Servizi Sas di G. Bombaci & C. where the same conditions are shown, in full:
Payment for the service must be made upon collection of the car from the car park according to the agreed rates. The collection of the car can take place upon release of the payment receipt, which is the only means of recognition and legitimacy;
It is recommended to check the data shown on the receipt of the parking lot in your possession (date, time, license plate, etc ..);
Unless otherwise agreed, to be agreed directly behind the Management, the vehicles will be driven to the parking areas directly by the driver / owner of the car following the indication / assistance of the staff appointed by Bombaci Servizi S.a.s;
The collection of the vehicles must take place only after payment at the Parking Box Office or at the exit through the automatic column;
For security reasons, access to the parking areas is allowed only to the driver of the car;
To return to the car park, please send a “Whatsapp” message, exceptionally, in the absence of the Whatsapp application, you can use an SMS or iMessage to request the courtesy shuttle service at least 30 minutes in advance. Otherwise the service will not be guaranteed. The service will be carried out exclusively at our stop;
We will not be held responsible for broken glass / glass and mirrors or dirty glass which cannot be inspected properly;
Unilateral disputes are not accepted;
The car park offers theFT and FIRE and CIVIL LIABILITY insurance;
The Company is not liable for damage caused by atmospheric events such as; hurricanes, storms, storms, wind
or things transported by it, tornadoes, hail, coming out of the usual banks of streams or bodies of water or artificial, storm surges, formations of streams, external accumulation of water, breakages or regurgitation of the drainage systems; earthquakes and tsunamis; frost, snow, avalanches, subsidence or landslide, floods and floods and any other natural event. Airone Parking is solely responsible for the total theft of the vehicle and limited to its commercial value; it also responds, reserving the right to contest any abuses, for the partial or total theft of accessories that are essential elements of the vehicle;
All items that have no functional and continuous connection with the asset are expressly excluded from the refund (e.g. clothing, jewelry, glasses, cash or other valuables, mobile phones and accessories, PDAs, similar devices and accessories, video cameras, cameras and accessories, satellite navigators, audio-video players and accessories, fountain pens, ballpoint pens and the like, remote controls not related to the use of the car, compact disks, computers, key rings, and any other valuable goods) for which the Customer must first remove them from the vehicle;
In the absence of a declaration and annotation by our representative on the delivery receipt, we will not accept any complaint;
Upon delivery of the vehicles to the car park, the actual conditions of the vehicles left in custody will be detected by means of an auto scanner system – located at the entrance;
The undersigned company cannot be considered responsible for damage and / or breakdowns to vehicles of a mechanical or electronic nature;
We do not accept disputes subsequent to the exit of the car park.
For anything not provided for, please refer expressly to the provisions of the Civil Code on the subject of filing (art. From 1766 to 1782) and, where in force, to the regulations on the subject.
In the event that one or more clauses of these General Parking Conditions are for any reason null, void, invalid, illegal or inapplicable for any reason, they will be deemed unwritten and this will not affect the validity and applicability of any other provision of these Parking Conditions.
The undersigned company reserves the unilateral right to modify these General Parking conditions at any time. The Court of Palermo will be competent to decide for any dispute concerning the validity, interpretation, execution and termination of these General Conditions.
Pursuant to art. 13 of Legislative Decree 196/2003 (hereinafter T.U), and in relation to the personal data that Bombaci Servizi S.a.s will come into possession of for the performance of the tasks referred to in this contract, the user is informed of the following. The treatment is aimed solely at the correct and complete execution of the custody of the vehicle at the Parking. Data processing is carried out by means of the operations or series of operations indicated in art. 4, paragraph 1, lett. A) T.U .: collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. The aforementioned operations can be carried out with or without the aid of electronic or automated means.
The processing is carried out by the Data Controller and / or by the persons in charge of the processing. Any refusal to the Company to confer from the so-called sensitive implies the impossibility of carrying out the custody of the vehicle at the parking lot.
Sensitive data may come to the attention of the persons in charge of the processing and may be communicated for the purposes related to the execution. Personal data are not subject to disclosure. Article 7 of the Consolidated Law on Finance grants the user the exercise of specific rights, including that of obtaining from the owner confirmation of the existence or otherwise of their personal data and their making available in an intelligible form; the user has the right to obtain the update, rectification and integration of data, cancellation, transformation into anonymous form or blocking of data processed in violation of the law; the owner has the right to object, for legitimate reasons, to the processing of data. The data controller is Bombaci Servizi S.a.s in the persons of its owners, with registered office in Via Volturno n. 8. The Data Processor is Bombaci Servizi S.a.s di G. Bombaci & C.
